Abstract

Artificial intelligence is considered one of the most recent topics influencing legal rules in general, and administrative law rules in particular, including administrative control rules, and the resulting application in this field, known as smart administrative control. This research aims to define smart administrative control, discuss its characteristics and objectives, and reveal the nature of its powers and means, with a focus on the extent of artificial intelligence’s influence on the idea of ​​administrative control. The research addressed what the Yemeni legislator has approved in this context and compared it with what the Emirati legislator has approved.
The research concluded with several results, the most important of which is that smart administrative control is a set of smart, preventative administrative decisions imposed by artificial intelligence tools to regulate activities within virtual reality; protecting traditional and virtual public order. It is characterized by being a technically unilateral, preventive, discretionary activity, and legally limited, with its application in virtual reality adapted to be a public or private space within the limits of the law. Artificial intelligence (AI) has not been recognized as a public administrative entity. Rather, it has been adopted as a tool for public administration in its activities, and the public administration bears responsibility for its negligence in this regard. Its most important means include monitoring individuals’ electronic activities, granting and revoking smart licenses for these activities, and potentially banning them. The Yemeni legislator has not indicated the possibility of applying AI to administrative control in any of its legislation. However, this is possible in the United Arab Emirates, according to the applicable Federal Law No. (34) of 2021 regarding combating rumors and cybercrimes. One of the most important recommendations of the research is the need to effectively apply AI to administrative control activities, due to the speed, accuracy, and low cost of taking action. The necessary legislative measures have been taken to achieve this.
